Domestic violence in New York: How these new laws will help to protect victims

Albany, New York — According to Gov. Andrew Cuomo, the new legislation establishes domestic violence advocate-victim privilege, which keeps their communications confidential under most circumstances.

Advocates may not disclose any communication they have with a client except in the following situations:

  • Intention to commit a crime or harmful act is revealed
  • If child abuse is suspected
  • If the client gives permission for the advocate to reveal information discussed

“Of the many societal ills laid bare during this pandemic, the scourge of domestic violence is among the ugliest,” Cuomo said. “Conversation between a domestic violence survivor and an advocate should be a safe space and I’m proud to sign this measure that puts this standard in place. Getting help is not always easy, but New York is doing all they can to ease the process for those put in this unthinkable position.”
