Livingston County man accused of injuring three-month-old baby
Nunda, New York – A 22-year-old man from Livingston County is facing charges after causing injuries to his three-month-old child.
According to Livingston County Sheriff’s deputies, Dustin Smith, 22, is charged with two counts each of attempted assault, assault, reckless endangerment and endangering the welfare of a child.
Sheriff’s deputies say that last week they they were contacted by Child Protective Services about a child being treated at a hospital for injuries considered suspicious. The injuries reportedly included fractures in both legs and to the child’s ribs, as well as possible fractures to upper arm bones.
Deputies say Smith caused the injuries by holding the child down.
Smith was arraigned and remanded to jail on $15,000 cash or $30,000 bond.
The child is said to be with family members outside the home. An order of protection was issued.
In a statement, Livingston County Sheriff Tom Dougherty said, “There is no greater crime than a crime against an innocent child. In this case, an infant who has no voice to tell, no ability to run away and apparently has no protector in the home. I commend the hospital staff that brought this to our attention, the caseworkers from Livingston County CPS for their great work, the Sheriff’s Investigators that aggressively investigated these heinous acts, as well as the judge that reviewed the case at arraignment and followed the recommendation on bail and the complete stay away order of protection.”
